They updated the regs a few years ago. It can be in-ground, but 15' from any structure or combustible, located on a property with a dwelling of two units or less, must be covered with a grate, and the wood has to be 3" or less in diameter, and the size of the fire itself can be no larger than 3'x3'x3' The wording is such that there is no size limit to the firepit, only the fire. No leaves or trash or things that are overly smokey or smell bad, and you must have a competent atendee with a hose or appropriate fire extinguisher.
