r/Pennsylvania on Reddit: Do I have any chance of avoiding sales tax on out of state vehicle (DE TOD)?
December 4, 2024 -

Yes, I know this question gets asked over and over in this sub, but my situation is somewhat unique:

Car purchased in DE 6 years ago by my father. Mid-2023 we applied for my name to be listed on the title as transfer-on-death (TOD) (DE https://legis.delaware.gov/SessionLaws/Chapter?id=16836). In early 2024, father passes away. Less than 6 months ago I have the title transferred (EDIT: still in Delaware btw) to my name per the previously declared TOD.

I've read that some tag/title places will tell you to say you purchased for $1, but others say the state won't let this slide. Hypothetical, if my father was alive and this was a gift instead of a death, would I still need to pay sales tax because none was paid in 2018?

Is there any chance having my name on the title as TOD would create an exception or count as ownership for > 6 months? I called a PA sales tax number and the best they told me was I could pay the tax and send an appeal given my circumstances. Does anyone know (or guess) if that could bring anything besides more headaches?

What Is The Pennsylvania Sales Tax On a Vehicle Purchase | eTags - Vehicle Registration & Title Services
October 19, 2020 - But the gift recipient must show that either the purchaser paid sales tax on the car when first bought, or he/she paid use tax on the current fair market value of the car to register the car in Pennsylvania. There’s a misconception that a minimal purchase price like $1 has to be reported on the MV-4ST form even when the car is gifted. But that’s incorrect, it often triggers a transaction review because the $1 is obviously less than market value. If you need to register a car as a gift in PA, you should fill out form MV-13ST; and Affidavit of Gift. While PA has sales tax on cars, did you know that Montana, Alaska, Delaware, Oregon, and New Hampshire don’t?
