Are you saying the artist sells the item to the customer, then pays your wife 30% of the sale? Who is making the initial sale, them or the artist? It sounds like your wife is selling to the consumer, right? Then yes, they need to be collecting and remitting sales tax on the sale. It's usually more often than just once a year, like quarterly. If they sell it for 100.00 even and do not collect sales tax, then they would have to pay the sales tax out of that 100.00. The fact that they take art in on commission does not change this. What the heck you don't have to pay sales tax if you buy in Texas but live in another state?
You have to pay sales tax in the state in which you’ll be registering it. All that form states is that we aren’t collecting sales tax as a part of the car deal. You still have to pay taxes in order to tag/register it when you get it home More on reddit.com
