It sounds like your wife is selling to the consumer, right? Then yes, they need to be collecting and remitting sales tax on the sale. It's usually more often than just once a year, like quarterly. If they sell it for 100.00 even and do not collect sales tax, then they would have to pay the sales tax out of that 100.00. The fact that they take art in on commission does not change this.
