Sorry to drudge up an older podcast, but I've just discovered it and it's really not sitting right with me. I've listened to a lot, but this one has really stuck out to me.
Maybe if I lay out the gaps, it'll help me.
My leading theory is it was suicide; the recent searches and maybe the place he may have been trying to get to having some sentimental reasoning (his grandpa's suicide).
My questions:-
I think I'm in the majority who think the phone was planted. Was it Penny? As she was worried it'll put a microscope under her, as there was some due to the fact it was kind of established she was lying about being asked for the passcode. Was it Klein? To get the limelight he obviously desperately craves? The man is a fucking joker, everything he said from the get-go bugged the hell out of me. Do you reckon Penny brought in a clown PI to take the stink off of her? "How could I have anything to do with it? I brought in a PI".
It might be an unpopular opinion, but I don't think Sheriff Lewis had anything to do with it. I know he really screwed up the initial (and most important) part of the investigation, but I reckon that was just due to him never doing a missing person's case before. He shouldn't be Sheriff, that's for sure, but I don't think he's a suspect.
I honestly don't understand why the nappy fetish got so much attention. Are they saying this in the way you'd speculate other theories such as "oh, if he liked that, what else was he up to?". Iirc, there was no evidence on meeting anyone irl, even if he was chatting to similar-minded people online. His friends and ex-girlfriend were amazing and so supportive. It must have been hard for them to see a friend's name dragged through the mud, even posthumously.
It also broke my heart to hear Penny say that she would have an issue with him being gay. I mean, there was nothing pointing to him being gay anyway, but you never know what's going on behind closed doors.
Do you think the podcast gives a good representation of small-city West Texas? I mean, I'm from the UK, so I'd love to know if it is!
I think that's it. Skip Hollandsworth did a great job imo. I loved his blunt style in interviews.

I just listened to this in 2 days after hearing about it often. I really wanted a resolution. If you’ve listened, what’s your view on what happened?
I’m not impressed with the PI and the mom. I wouldn’t hesitate to say I just want my son back, no matter what but she clearly didn’t say that. She was more accepting of diapers. I thought it was quite poignant of Skip to ask that question at the end. Poor Tom, he sounded like a stand up kid.

I think it was suicide, but also some evidence was planted to make it look like a murder. It's been a while since I listened to be gentle if I mess up any details here.
My theory on the phone: one of his friends or family members had it or found it later. They gave it to the shady PI who convinced them to stay quiet when he planted the phone during the search. I don't think this person had bad intent, but maybe the PI told them that they needed to do this to get the police invested in the case.
Given the insane amounts of $$$ the family has paid the PI, I think they genuinely believe it was a murder though.
On a side note, I remember not being super convinced that Tom was gay. It got floated a lot, and he definitely could have been, but it seemed like everyone equated diapers=being gay? He could have been depressed for so many reasons, not feeling accepted in his sexuality is just one of them.
