Amazon Fresh Store Charging Tax on Food Against California Law
Sales taxes in California are far more complex than this and they apply on a lot more than merely "hot prepared food products." It would take pages and pages of explanations and examples to describe what is taxed or not. Carbonated drinks are taxed. Snack foods are taxed, but exactly what defines a snack food isn't precisely included in the law and is left to the State Board of Equalization to decide. Sometimes food is taxed based on location, intent and other ambiguous factors. For example, a cold sandwich that is sold to-go and not consumed on the premises is not taxed, unless it's sold as a combo meal that includes a soda or chips/snack, in which it is taxed. A cold sandwich is taxable if served on a tray to eat on the premises. A full-size cake isn't taxed, but small cakes like Twinkies or Ding Dongs are taxed. What specific law is the retailer violating? There appears to be no law or regulations preventing retailers from charging sales tax on non-taxable foods so long as they send the tax to the state. Retailers can choose to collect more than required, but not less. In fact, the regulations specifically allow tax to be charged on non-taxable items in specific situations, such as the 80/80 rule. Amazon charges 9% tax while other online retailers charge 6.25% for electronic products, anyone knows why?
Basically, in most cases marketplace sellers (e.g. Amazon) are required to collect sales tax at the delivery location's local rate. That's not the case for out of state sellers who don't use a marketplace.
