Identical Temporary TABOR Refund | Colorado General Assembly
The act creates a new temporary refund mechanism (temporary TABOR refund), which is contingent on the voters approving proposition HH at the November 7, 2023, statewide election, that replaces the sales tax refund mechanism for the 2022-23 state fiscal year. Under this mechanism, each qualified individual is eligible to receive an identical refund payment from the remaining excess state revenues from all sources after refunds are made through the county reimbursement mechanisms (remaining excess state revenues).

Prior to tax year 2022, the Colorado income tax rate could be temporarily reduced to 4.50% if there was enough TABOR surplus. However, starting with tax year 2022, voters permanently reduced the income tax rate to 4.40%, as specified in Sections 39-22-104(1.7)(c) and 39-22-301(1)(d)(I)(K) of the Colorado Revised Statutes. This refund mechanism can be triggered in two circumstances:
