From the comments apparently this needs to be abundantly clear. TALK TO YOUR LAWYER, if you don't have one, find one. (it's easy) Do not assume ANYTHING. Their job is answer your questions, and find a solution for you, like who is liable. It's easier to do it under your name, but you should always put it under a company. The main advantage is protection, if say you make a great accounting app, made a bit of a mistake on the calculations and someone just lost 10k because they wanted to use a $3 app instead of a full accounting application, and they go to sue you. Without a company in front of if they can sue YOU, vs only able to go after the company. If you're company looses and don't have the 40k for "damages" they claim, you file bankruptcy on the company and keep all your personal money and assets vs attempting to pay it off personally. A company is necessary if you plan to take this seriously, and the advantages are to having one are great. It's also pretty cheap to get one started. It's worth noting that I'm not %100 sure this all applies to a LLC specifically. But there are plenty of lawyers dedicated to the setup of companies and still pretty cheap few hundred can get the job done. It also I personally feel looks a lot better in the application and for some reason portrays a bit more professionalism to the end user. More on reddit.com
