Hi all, I've read through the 12 steps Guide but I think I am too late to request the Trial by Written Declaration.
A little backstory on how I got the ticket: it was in Nov 2020 and I was driving from SF back to LA after visiting my boyfriend and I actually started my drive at 2am because I was aiming to get back to LA in the morning. I did take naps throughout the entire drive but towards the Grapevine area I was exhausted and since it is the last leg I decided to gun for it (I know, I shouldn't have done that but I was in a hurry to get back home). I was clocked at 103mph on a 65mph freeway, it was a brief interaction between me and the officer, he asked why I was speeding I said I dont know (it was my first interaction with a CHP and I was a bit scared and did not know what to do). He didnt showed me proof of my speed with his LIDAR gun. He gave me my ticket and I drove off. On the bottom of the ticket, the location of the court is Santa Clarita Courthouse and I was supposed to show up in mid Feb 2021 for my arraignment. But at the end of Dec 2020, my grandpa passed away and I had to be out of country for a whole month and I was scared that I wont be able to make it to the arraignment so I call the court and ask them to reschedule me. The clerk rescheduled me to end of May 2021 at the Chatsworth courthouse to which I showed up and said not guilty and my trial is in the beginning of August 2021. She did offered me a no contest option: reduced fine + 9 hrs community service + 2 points off my license, traffic school is not an option.
Here are some of my questions:
(1) Can I still request TWBD?
(2) Would the probability of the CHP officer showing up is low-ish since my court is different than the court he wrote down (its approx 40mins away between the courts, that is without traffic) and also because it has been dragged out too long? (I also scheduled it on a Friday at 1:30pm if that helps)
(3) What are some of the questions that I can cross examine the officer if he does show up? I was gonna bring up is his LIDAR gun is calibrated and did he LIDAR the right vehicle since I was in the far left most lane when he was at curb next to the far right most lane. (there are 3 lanes total)
(4) is CHP officer required to show proof of my speed to show I am speeding? If so can I cross examine him by asking why he did not show me proof of that?
(5) How do I question the credibility of the officer's memory? Like do I just state that I challenge the credibility of the officer's memory since the ticket has been issued more than 6 months ago?
(6) I am 24 years old and I heard of a program call Alive at 25 which i guess it is kinda like a traffic school for people under the age of 25. My boyfriend actually had the same speeding ticket as me and his case basically got dismissed during his arraignment and all he needed to do was that Alive at 25 traffic school and like 12 hours of community service (that is VERY lucky of him considering he has the same ticket as I, in addition he got his ticket in SF not sure where but I feel like LA people are less lenient on the speeding ticket citation?)
I think my main defense is that I was going with the flow of traffic, cars were definitely not going the speed limit around me, and since it has been a long time since the ticket is issued the officer's memory is faulty. Another funny-ish defense would be my car is always on ECO mode and it is harder for my car to get up to speed since it is uphill and my transmission shifts at a lower RPM at the location that I was pulled over.
