Hi all,

Looking for advice on a weird issue, well weird to me. I was rear-ended in a car accident, needed to go to ER, had therapy etc... I hired an attorney and things were decent for the first month or so. Then he stopped returning calls, or rather would return calls but several days later, as well not really communicating with me on the status of things. Come weeks later, he calls me and tells me, not the exact reason, but said he can't be my lawyer anymore because he has been suspended from practicing law and can't get into any other details. He said I can find a new lawyer, but I still have to pay him for the time he's spent on the case so far. Is this normal? I mean, why should I be penalized because he messed up to the point of being suspended for practicing laws for years? I am at a loss because I had heaps of bills piled up from the ER and chiropractor etc...any advice?

I mean, IS he entitled to pay for the hours he worked on your case? Yeah, the State Bar would likely, in a vacuum, find it to be so if he wanted to push the issue. Now, would you be able to sue him / file a fee dispute / file a grievance such that he would decide it wasn't worth the headache and refund you most (if not all) of your money back? I'd be lying if I said I've never seen another lawyer decide to do this because they're stressed at dealing with the lawyer regulation board. (To be clear, him telling you this isn't the unethical part; he's required to do so before his suspension starts. Him just shrugging and saying "Go find another lawyer" and being apathetic about your case is likely the thing the lawyer regulation board won't look too kindly on)

You should contact the bar association in your jurisdiction and report this issue. Lawyers have professional insurance that responds to issues like this, and most bar associations offer a lawyer trust service that will find you a lawyer to take on your case where your last lawyer left off. Re the matter of the lawyers invoices/accounts, if he rendered an account to you prior to his suspension it should be paid. If he has not rendered an account to you, then you don't owe him any more money. Other lawyers will hate this, but if you truly have a good reason to refuse to pay this lawyers accounts you can apply to have them assessed. Basically like suing your lawyer. Most lawyers will assess whether they are at risk of losing an assessment, and if they are, offer you a discount. But if this guy got suspended, he may not be a sensible person.
