Supreme Court tariff ruling: It's not just about refunds. Volume of U.S. freight trade could hinge on decision
3 days ago - If the tariffs are ruled illegal, the Court of International Trade has the legal authority to require refunds are paid to U.S. importers and retain jurisdiction over claims for refunds for a two-year statute of limitations period. At the same time, the Trump administration has said if the Supreme Court rules against it, there is already a plan in place to implement tariffs using other legal provisions.

How the tariffs could be refunded if the court sides against Trump - SCOTUSblog
1 month ago - Barrett’s exchange with Katyal raises a number of questions about what would happen if the court strikes down the tariffs. First and foremost is whether importers that have already paid the tariffs – totaling more than $200 billion so far this year, the Trump administration announced on Monday – would be entitled to refunds. And if they are, how might that refund process work? There are no clear answers, but history and several of the Supreme Court’s past decisions may provide some guidance.

Trump's Tariffs Quietly Forced 700 American Companies to File for Bankruptcy in 2025
From the article: The first half of the year saw 17 significant bankruptcies involving businesses with assets worth more than $1 billion. More than 700 U.S. businesses filed for bankruptcy in 2025, the highest number since 2010 and a 14% increase from 2024. In contrast to previous patterns that were dominated by retail bankruptcies, this year’s impacted industries were primarily industrial, such as manufacturing and transportation. Chapter 7 liquidations and Chapter 11 reorganizations made up the total number of filings. The figures were calculated according to a recent survey by S&P Global Market Intelligence. If the Supreme Court declares trumps tarriffs unconstitutional which stocks will benefit most?
Large importers right? Costco, Amazon, etc. Probably fashion brands like LULU and LVMH that import a lot too. More on reddit.com

Trump tariffs panned by Bernanke, Yellen in Supreme Court filing
I don’t get why Congress has decided that the best way to make laws is by EO then SCOTUS rulings. Seems like republicans have broken the legal system intentionally to do a run around the law and get their goal of installing a dictator finalized. This whole fiasco was just an attempt for Trump to shake down the world and be lavished with gifts like a 17th century prince. Heritage gets to install a dictator and the dictator gets to use the state as a means to enrich himself. The corruption is stunning. The financial illiteracy is dumbfounding. The slavish groveling of men who know better, pathetic. The outright goal of ending the American experiment— treasonous. More on reddit.com

Supreme Court justices appear skeptical that Trump tariffs are legal
In my scattered reading on this, it sounds like one of the administration's main arguments is that even if *this way* of doing tariffs is illegal, there are several other tools they have to implement tariffs, albeit at a lower level. Well, SO WHAT? It's still illegal, and needs to be kicked to the curb. "Yeah, your honor, I did steal $10mil from the bank, but I *could* have earned it totally legally, so why not just let me keep this money?" More on reddit.com
