Voidable marriage - Wikipedia
March 22, 2026 - The marriage is valid but is subject to cancellation if contested in court by one of the parties to the marriage. A voidable marriage is contrasted with a void marriage, which is one that is on its face unlawful and therefore legally has no effect, whether or not one of the parties challenges the marriage.
Statutory Grounds for Seeking a Voidable Marriage Annulment
The legal threshold for a voidable marriage depends on the existence of a fundamental impediment that prevented informed or legal consent to the marital contract. Because the law presumes the validity of a marriage, the burden of proof rests entirely on the petitioner to provide clear and convincing evidence of the defect. If the court finds that the petitioner continued to live as a spouse after the impediment was discovered, the right to an annulment may be forfeited, leaving divorce as the only available path for dissolution.

Strategic Advantages of Annulment over Traditional Divorce
Securing a voidable marriage annulment offers significant tactical advantages in asset preservation, as it typically precludes a spouse from claiming a share of marital property or seeking long-term alimony. Because an annulment declares that a valid marriage never existed, the standard laws governing the equitable distribution of marital assets often do not apply. This is a critical distinction for high-net-worth individuals who wish to protect their professional legacy and pre-marital holdings from a spouse who entered the union under false pretenses.

Voidable includes a choice. Someone may decide whether to void the marriage or not. An example would be if you were drunk when you got married. You might decide that you didn't want to do that, and ask a judge to annul the marriage. You might also choose to stay married. Void doesn't include choice. An example would be if you married someone who was still married to someone else. That marriage is void, because it cannot legally exist. You can choose to marry that person again, after they divorce, but you cannot choose to simply stay married.

Usually, I think of "void" as meaning something was not valid from the beginning, relative to everybody. "Voidable" means that somebody has to make an election to cancel the thing, and only certain people (including courts) can make that election. https://thelawdictionary.org/?s=voidable
