In other words, while it was previously up to a court to determine whether an exception applied, it is now up to the DOL. This is a material change in the law. Under the new regulations, an employer must submit its request for an exception within 10 business days of when the written WARN notice would be due to the DOL commissioner, unless the DOL commissioner grants an extension.

WARN Act [NY]: Am I required to keep doing work for the company that's laying me off?
Employers are required to tell you, or they have to pay you. They told you, so they don't have to pay you if you stop working. You can still be fired before the 90 days. You are not entitled to a penny if you resign or are terminated for cause since they have notified you. More on reddit.com

FYI about WARN Notices. The NYS WARN Act requires covered businesses to provide early warnings of closures and layoffs to all affected.
FYI some companies stagger layoffs to somehow avoid having to actually appear on this list. I’m not sure how that is allowed. More on reddit.com

[NY] warn act and unemployment pay
File now (you’re going to have to when the payments dry up anyway) and let the state decide. Usually if you are receiving payments for a job, severance, etc, you only receive the difference of what UI would pay. So if your earnings in a week were $100 and UI would have paid $50, you don’t get anything. More on reddit.com
